Limited Warranty

If you acquired your Microsoft Product in the US , the following limited express warranty applies to you:

Microsoft warrants that (a) the SOFTWARE PRODUCT will perform substantially in accordance with the accompanying written materials for a period of ninety (90) days from the date of receipt, and (b) any Support Services provided by Microsoft shall be substantially as described in applicable written materials provided to you by Microsoft, and Microsoft support engineers will make commercially reasonable efforts to solve any problem issues. Some states and jurisdictions do not allow limitations on duration of an implied warranty, so the above limitation may not apply to you. To the extent allowed by applicable law, implied warranties on the SOFTWARE PRODUCT, if any, are limited to ninety (90) days.

CUSTOMER REMEDIES. Microsoft’s and its suppliers’ entire liability and your exclusive remedy shall be, at Microsoft’s option, either (a) return of the price paid, if any, or (b) repair or replacement of the SOFTWARE PRODUCT that does not meet Microsoft’s Limited Warranty and which is returned to Microsoft with a copy of your receipt. This Limited Warranty is void if failure of the SOFTWARE PRODUCT has resulted from accident, abuse, or misapplication. Any replacement SOFTWARE PRODUCT will be warranted for the remainder of the original warranty period or thirty (30) days, whichever is longer. Outside the United States, neither these remedies nor any product support services offered by Microsoft are available without proof of purchase from an authorized international source.

NO OTHER WARRANTIES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MICROSOFT AND ITS SUPPLIERS DISCLAIM ALL OTHER WARRANTIES AND CONDITIONS, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, WITH REGARD TO THE SOFTWARE PRODUCT, AND THE PROVISION OF OR FAILURE TO PROVIDE SUPPORT SERVICES. THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS. YOU MAY HAVE OTHERS, WHICH VARY FROM STATE/JURISDICTION TO STATE/JURISDICTION.

LIMITATION OF LIABILITY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MICROSOFT OR ITS SUPPLIERS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE PRODUCT OR THE PROVISION OF OR FAILURE TO PROVIDE SUPPORT SERVICES, EVEN IF MICROSOFT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY CASE, MICROSOFT’S ENTIRE LIABILITY UNDER ANY PROVISION OF THIS EULA SHALL BE LIMITED TO THE GREATER OF THE AMOUNT ACTUALLY PAID BY YOU FOR THE SOFTWARE PRODUCT OR U.S.$5.00; PROVIDED, HOWEVER, IF YOU HAVE ENTERED INTO A MICROSOFT SUPPORT SERVICES AGREEMENT, MICROSOFT’S ENTIRE LIABILITY REGARDING SUPPORT SERVICES SHALL BE GOVERNED BY THE TERMS OF THAT AGREEMENT. BECAUSE SOME STATES AND JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

 

 

 

 

 

 

 

If you acquired your Microsoft Product in Australia, New Zealand, or Papua New Guinea, the following limited express warranty applies to you:

 

CONSUMER RIGHTS.  Consumers may have the benefit of certain rights or remedies pursuant to the Trade Practices Act and similar state and territory laws in Australia or the Consumer Guarantees Act in New Zealand, in respect of which liability may not be excluded.    The warranties and rights set out below are provided by Microsoft and are in addition to those you may have under the above Acts against importers or resellers of the SOFTWARE PRODUCT.

 

LIMITED EXPRESS WARRANTY.  Microsoft warrants that:

 

(a)               the SOFTWARE PRODUCT will perform substantially in accordance with the accompanying written materials for a period of 90 days from the date of receipt; and

 

(b)               any support services provided by Microsoft shall be substantially as described in applicable written materials provided to you by Microsoft, and Microsoft support engineers will make commercially reasonable efforts to solve any problem issues. 

 

CUSTOMER REMEDIES.  To the maximum extent permitted under applicable law, Microsoft’s and its suppliers’ entire liability and your exclusive remedy under this warranty is, at Microsoft’s option, either (a) return of the price paid, if any; or (b) repair or replacement of the SOFTWARE PRODUCT which does not meet this warranty and which is returned to Microsoft with a copy of your receipt.  This warranty is void if failure of the SOFTWARE PRODUCT has resulted from accident, abuse or misapplication.  Any replacement SOFTWARE PRODUCT will be warranted for the remainder of the original warranty period or 30 days, whichever is longer.  Outside the United States neither these remedies nor any product support services offered by Microsoft are available without proof of purchase from an authorised international source.

 

LIMITATION OF LIABILITY.  To the maximum extent permitted by applicable law, Microsoft and its suppliers disclaim all other warranties and conditions, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, with regard to the SOFTWARE PRODUCT, and the provision of or failure to provide support services.  Consumers may nevertheless have the benefit of certain rights or remedies pursuant to the Trade Practices Act and similar state and territory laws in Australia or the Consumer Guarantees Act in New Zealand, in respect of which liability may not be excluded.  Insofar as such liability may not be excluded, then to the maximum extent permitted by law, such liability is limited, at Microsoft’s exclusive option, to (i) in the case of the SOFTWARE PRODUCT: (a) replacement of the SOFTWARE PRODUCT; or (b) correction of defects in the SOFTWARE PRODUCT; or (c) the cost of having defects in the SOFTWARE PRODUCT repaired; or (ii) in the case of support services:  (a) resupply of the services or (b) payment of the cost of having the services supplied again.

 

EXCLUSION OF LIABILITY/DAMAGES.  The following is without prejudice to any rights you may have at law which cannot legally be excluded or restricted.  You acknowledge that no promise, representation, warranty or undertaking has been made or given by Microsoft (or its suppliers) or by any person or company on their behalf in relation to the profitability of or any other consequences or benefits to be obtained from the delivery or use of the SOFTWARE PRODUCT or written materials.  You have relied upon your own skill and judgment in deciding to acquire the SOFTWARE PRODUCT, any accompanying hardware, manuals and written materials or support services.  Except as and to the extent provided in this agreement, neither Microsoft nor its suppliers nor any related company will in any circumstances be liable for any other damages whatsoever (including, without limitation, damages for loss of business, business interruption, loss of business information or other indirect or consequential loss) arising out of the use, or inability to use, or supply, or non-supply, of the SOFTWARE PRODUCT or any written material) or any support services.  Microsoft’s total liability under any provision of this agreement is in any case limited to the amount actually paid by you for the SOFTWARE PRODUCT and/or any support services or US$5.00.

 

SUPPORT SERVICES AGREEMENT.  If you have entered into a Microsoft support services agreement, Microsoft’s entire liability regarding support services shall be governed by the terms of that agreement and not by the terms of this limited express warranty.

 

This agreement is governed by the laws of New South Wales, Australia or, where supplies are made in New Zealand, by the laws of New Zealand.

 

 

 

 

 

 

 

 

 

 

 

 

 

Indien u uw Microsoft-product in de Benelux hebt aangeschaft, geldt de volgende beperkte garantie voor u:

BEPERKTE GARANTIE. Microsoft garandeert dat (a) het SOFTWAREPRODUCT in hoofdzaak functioneert overeenkomstig

Voor een vervangend SOFTWAREPRODUCT zal een garantieperiode gelden gelijk aan de resterende tijd van de oorspronkelijke garantieperiode of, indien dat langer is, dertig (30) dagen. In landen buiten de Verenigde Staten zijn noch deze verhaalsmogelijkheden noch enige productondersteuning die wordt geboden door Microsoft, beschikbaar zonder het bewijs van licentieaankoop afkomstig van een geautoriseerde internationale bron.

GEEN ANDERE GARANTIES. VOOR ZOVER MAXIMAAL IS TOEGESTAAN OP GROND VAN TOEPASSELIJK RECHT WIJZEN MICROSOFT EN HAAR LEVERANCIERS ALLE GARANTIES VAN DE HAND EN ERKENNEN GEEN SPECIALE OMSTANDIGHEDEN, NOCH UITDRUKKELIJK NOCH IMPLICIET, DAARONDER MEDE BEGREPEN MAAR NIET BEPERKT TOT IMPLICIETE GARANTIES BETREFFENDE DE VERKOOPBAARHEID, DE GESCHIKTHEID VOOR EEN BEPAALD DOEL, HET EIGENDOMSRECHT OF HET NIET-INBREUKMAKEND KARAKTER VAN HET SOFTWAREPRODUCT EN HET VERSTREKKEN OF HET NIET VERSTREKKEN VAN PRODUCTONDERSTEUNING. DEZE BEPERKTE GARANTIE VERLEENT U SPECIFIEKE WETTELIJKE RECHTEN. HET IS MOGELIJK DAT U DAARNAAST NOG ANDERE RECHTEN HEBT DIE VERSCHILLEN VAN STAAT/RECHTSGEBIED TOT STAAT/RECHTSGEBIED. Indien u dit product in Luxemburg hebt verkregen, wordt deze Overeenkomst beheerst door het recht van Luxemburg.

Indien u dit product buiten de hierboven genoemde landen hebt aangeschaft, kan lokaal recht van toepassing zijn.

U.S. GOVERNMENT RESTRICTED RIGHTS. The software product and documentation are provided with restricted rights. Use, duplication, or disclosure by the government is subject to restrictions as set forth in subparagraph (c)(1)(ii) of the rights in technical data and computer software clause at dfars 252.227-7013 or subparagraphs (c)(1) and (2) of the commercial computer software—restricted rights at 48 cfr 52.227-19, as applicable. This EULA is governed by the laws of the State of Washington.

Caso você tenha adquirido seu produto Microsoft no Brasil, a seguinte garantia limitada aplica-se a você:

GARANTIA LIMITADA — A Microsoft garante que (a) o SOFTWARE desempenhará suas funções substancialmente em conformidade com seu(s) manual(is), por um período de 90 (noventa) dias a contar da data da entrega; (b) qualquer Serviço de Suporte fornecido pela Microsoft será substancialmente, conforme descrito nos manuais aplicáveis, fornecido a você pela Microsoft, e os Engenheiros de Suporte da Microsoft farão os esforços comercialmente razoáveis para solucionar quaisquer problemas que ocorram. Alguns estados e jurisdições não permitem limitações à duração de garantia legal, hipótese na qual a limitação acima poderá não se aplicar a você. Sem prejuízo do disposto em lei aplicável, as garantias implícitas sobre o Software, se existentes, são limitadas a 90 (noventa) dias.

DIREITOS DO CLIENTE — A responsabilidade integral da Microsoft e de seus fornecedores, e o seu único direito será, a critério da Microsoft, (a) a devolução do preço pago, se existente, ou, alternativamente, (b) o conserto ou substituição do SOFTWARE, sujeito aos termos da Garantia Limitada, que seja devolvido à Microsoft com a cópia do recibo. Esta Garantia Limitada será nula e não gerará efeitos
se o defeito do SOFTWARE resultar de acidente, utilização abusiva ou inadequada. Qualquer SOFTWARE substituído será garantido pelo prazo remanescente da garantia original ou por 30 (trinta) dias, no caso deste último prazo ser mais extenso. Fora dos Estados Unidos da América, nenhum destes direitos ou qualquer Serviço de Suporte ao produto oferecido pela Microsoft estará disponível sem a comprovação de compra de fonte internacional autorizada.

NENHUMA OUTRA GARANTIA — NA EXTENSÃO MÁXIMA PERMITIDA PELA LEI APLICÁVEL, A MICROSOFT
E SEUS FORNECEDORES REJEITAM QUAISQUER GARANTIAS OU CONDIÇÕES, QUER SEJAM EXPRESSAS OU IMPLÍCITAS, INCLUINDO, MAS NÃO SE LIMITANDO A, GARANTIAS IMPLÍCITAS DE COMERCIALIZAÇÃO E ADEQUAÇÃO A UMA FINALIDADE ESPECÍFICA, TÍTULO E NÃO VIOLAÇÃO, COM RELAÇÃO AO SOFTWARE E À PRESTAÇÃO OU FALHA NA PRESTAÇÃO DE SERVIÇOS DE SUPORTE. ESTA GARANTIA LIMITADA LHE CONFERE DIREITOS ESPECÍFICOS. VOCÊ PODE GOZAR DE OUTROS DIREITOS, CONSIDERANDO QUE HÁ VARIAÇÃO DE ESTADO/JURISDIÇÃO PARA ESTADO/JURISDIÇÃO.

LIMITAÇÃO DE RESPONSABILIDADE — NA EXTENSÃO MÁXIMA PERMITIDA PELA LEI APLICÁVEL, EM NENHUMA HIPÓTESE A MICROSOFT OU SEUS FORNECEDORES SERÃO RESPONSÁVEIS POR QUAISQUER DANOS ESPECIAIS, INCIDENTAIS, INDIRETOS OU CONSEQÜENCIAIS (INCLUINDO, MAS NÃO SE LIMITANDO A, LUCROS CESSANTES, INTERRUPÇÕES COMERCIAIS, PERDA DE INFORMAÇÕES COMERCIAIS OU QUALQUER PERDA FINANCEIRA) DECORRENTES DO USO, OU DA INCAPACIDADE DE USAR O SOFTWARE OU DA PRESTAÇÃO OU FALHA NA PRESTAÇÃO DE SERVIÇOS DE SUPORTE, AINDA QUE A MICROSOFT TENHA SIDO ALERTADA QUANTO
À POSSIBILIDADE DE TAIS DANOS. EM QUALQUER CASO, A RESPONSABILIDADE INTEGRAL DA MICROSOFT SOB ESTE CONTRATO LIMITAR-SE-Á AO VALOR EFETIVAMENTE PAGO PELO SOFTWARE OU US$5,00 (CINCO DÓLARES AMERICANOS), O QUE FOR MAIOR. CASO VOCÊ TENHA TOMADO PARTE EM UM CONTRATO DE SERVIÇOS DE SUPORTE DA MICROSOFT, A RESPONSABILIDADE INTEGRAL DA MICROSOFT SERÁ REGIDA PELOS TERMOS DE TAL CONTRATO. CONSIDERANDO QUE ALGUNS ESTADOS/JURISDIÇÕES NÃO PERMITEM A EXCLUSÃO OU LIMITAÇÃO DE RESPONSABILIDADE, A LIMITAÇÃO ACIMA PODE NÃO SE APLICAR A VOCÊ.

Caso você tenha adquirido este produto nos Estados Unidos, este Contrato será regido pelas leis do Estado de Washington. Caso este produto tenha sido adquirido fora dos Estados Unidos, a legislação local poderá ser aplicada.

If you acquired your Microsoft Product in Canada, the following limited warranty applies to you:

LIMITED WARRANTY. Microsoft warrants that (a) the SOFTWARE PRODUCT will perform substantially in accordance with the accompanying written materials for a period of ninety (90) days from the date of receipt, and (b) any Support Services provided by Microsoft shall be substantially as described in applicable written materials provided to you by Microsoft, and Microsoft support engineers will make commercially reasonable efforts to solve any problem issues. Some states and jurisdictions do not allow limitations on duration of an implied warranty, so the above limitation may not apply to you. To the extent allowed by applicable law, implied warranties on the SOFTWARE PRODUCT, if any, are limited to ninety (90) days.

CUSTOMER REMEDIES. Microsoft’s and its suppliers’ entire liability and your exclusive remedy shall be, at Microsoft’s option, either (a) return of the price paid, if any, or (b) repair or replacement of the SOFTWARE PRODUCT that does not meet Microsoft’s Limited Warranty and which is returned to Microsoft with a copy of your receipt.
